Maine hasn't issued bar guidance or a court rule aimed at how lawyers use AI in practice. But a new consumer protection statute reaches further than most lawyers expect, covering any firm that uses an AI chatbot to talk to prospective clients.
Where Maine Stands
No Maine bar ethics opinion or court rule addresses AI use in legal practice. The one instrument on the books, 10 M.R.S. § 1500-DD (enacted as LD 1727, PL 2025 c. 294), regulates AI chatbot disclosure in trade and commerce generally, not lawyers specifically, but it applies to any firm that fits its terms.
What Your Firm Must Do
If your firm uses an AI chatbot for client intake or marketing aimed at Maine consumers, you must clearly and conspicuously tell users they are not interacting with a human whenever a reasonable person could be misled. A violation is treated as a Maine Unfair Trade Practices Act violation.
