AI Rules for Michigan Law Firms

Last verified July 8, 2026

Michigan has no AI-specific statute or filing disclosure rule for lawyers, but judicial ethics guidance, a State Bar FAQ, and a 2024 judiciary workgroup report together sketch a court system paying close attention to how AI shows up in filings and evidence. This page lays out what each source actually says your firm needs to do.

Where Michigan Stands

No Michigan court rule requires disclosure of AI use in filings today. Instead, Judicial Ethics Opinion JI-155 requires Michigan judicial officers to maintain competence with AI and continually evaluate how parties before them use it, which means firms should expect judicial scrutiny of AI-assisted filings and AI-generated evidence even without a formal disclosure requirement. The Michigan Judicial Council's Generative AI and the Courts Workgroup Report and Recommendations, issued in 2024, recommends AI governance for the courts and flags hallucination and deepfake evidence as risks, signaling that statewide court AI policy may follow. That scrutiny is no longer theoretical: in Barber v Morawa, MD, No. 374773 (Mich. Ct. App. June 17, 2026), the Court of Appeals sanctioned plaintiff's counsel for repeatedly submitting AI-fabricated and unsupported citations in both a trial-court motion and the appellate brief, holding that the conduct violated MCR 1.109(E)(5), and directed the Clerk to forward the opinion to the Attorney Grievance Commission.

What Your Firm Must Do

The State Bar of Michigan's Artificial Intelligence FAQs, while nonbinding, tell lawyers not to input client confidences into AI tools without safeguards, to verify every AI-generated citation before filing, and to supervise staff and vendor use of AI under Rules 5.1 and 5.3.
